Wilmington Delaware Asbestos Litigation

News reports show in June 2018, a Delaware jury returned a $40.6 million verdict in favor of the widow of a mesothelioma victim. The jury applied New Mexico law and found Ford strictly liable due to their failure to warn of the dangers of asbestos and 20 percent responsible for the accident. The jury found the decedent 30 percent at fault. The remaining 50 percent was divided between General Motors, Chrysler and Johns-Manville. The appellate court in Wilmington upheld the decision, finding that the evidence and experts satisfied New Mexico’s causation standard.
