Because Oregon has a lower rate of asbestos than many other states, there are fewer cases that go to trial. Those that do are often filed in other jurisdictions. For example, the family of an Oregon metals factory worker who died from mesothelioma filed a lawsuit against Garlock Sealing Technologies in 2004, which manufactured gaskets that the man used while working at his job. The jury awarded him $1.29 million after the man’s widow claimed he had developed mesothelioma after being exposed to the gaskets produced by Garlock. The jury specifically found that Garlock’s gaskets included a marketing defect and failed to warn the man and others of dangers associated with exposure to asbestos in the gaskets. Other defendants were initially named in the lawsuit but settled with the family before the verdict.
